Online travel companies are the new target of the North Carolina Department of Revenue (NCDOR) in an attempt to fill state coffers. After losing a battle against Amazon.com over the sales tax law amendments, NCDOR is trying to alter the sales tax law applicable to online travel companies. This has led six travel companies to file suit against it, arguing that the sales tax amendment violates the Internet Tax Freedom Act.
The amendment is taking account of fees charged by third-party intermediaries like the ones collected by Orbitz, Trip Network, Travelocity, Travelscape, Hotels.com and Hotwire; the plaintiffs. These online travel companies regard it as discriminatory because it raises tax on online dealings compared to offline transactions. Also, it impairs their contracts with hotels.
Maintaining that they are not retailers and do not require collecting such a sales tax, online travel companies want the amendment declared unconstitutional and void.
